Right up front. I am not a lawyer nor do I propose to give advice for which I am not qualified. Whatever is included on these pages is simply to give you resources for more information before you contact a lawyer or qualified specialist in the subject area. Also by using these materials you take responsibility for all decisions you make regarding the resources listed here.
These listings DO NOT imply endorsement of the sites.
However I do know that especially in the Province of Ontario it is VERY important to have a will, power of attorney, and living will regarding matters of health.
IF YOU DO NOT HAVE ONE, the Province will appoint a high-priced lawyer to make decisions for you regarding the disposition of your estate and/or if you are incapacitated so you cannot make your own decisions regarding your life and health, those decisions will be made for you by the above said lawyer at high cost to your estate.
MORAL OF THE STORY is ... GET A WILL, GET A POWER OF ATTORNEY, and GET A 'LIVING WILL'
I have simply done searches on the internet and included pages which seem to have information helpful to you. This list is NOT a recommended list of individuals, companies or websites. Most do business in the Province of Ontario.
Financial Books to Read
I heartily recommend a number of books for those who wish to make their financial life easier without working harder and longer hours!
- "Personal Finance for Canadians for Dummies" by Eric Tyson, Financial counsellor syndicated columnist, and bestselling author and Tony Martin, Personal finance commentator, national columnist, and co-author of "Investing for Dummies". [in the U.S. the title is the same without the reference to Canadians]
- "The ABC's of Making Money" by Dr. Denis L. Cauvier and Alan Lysaght. Dr. Denis Cauvier is a speaker-trainer-consultant, who has made a career out of helping his clients become financially successful, a former personal and corporate lender, accredited personal financial advisor with two of North America's largest banks. Alan Lysaght is a Strategic Planning and financial consultant-trainer specializing in low-cost, high-impact 'turnaround' management solutions for businesses and private individuals, as well as a writer-researcher with degrees in Psychology, Sociology and English Literature. In his spare time, he is an award-winning Documentary Producer.

http://www.legalwills.ca/?ref=gaw_caw_on - At this site you can draw up a will from $34.95. If you want them to store it for you as well, that costs extra. But still a very reasonable cost for an uncomplicated will. They of course, offer advanced services at "advanced prices"!
It is worthwhile to read the following information taken from the site as a warning about "Legal Will Kits". Remember that ALL the information below was taken from their site.
- "Is it a legal will? When a document claims to be a legal will you have to understand what that means. If I type on a piece of paper This is the Last Will and Testament of me, John Doe, of Toronto, Ontario. I leave my entire estate to my son James Doe. Then, if I sign the document in front of two witnesses, and date it then I have a legal will. That is how a vendor can get away with calling their product a "legal will kit". Here is another example of a popular will kit, which once again leaves the consumer with the daunting task of trying to figure out how to fill in the blanks."
- "You must plan for the unexpected. As lawyers tend to point out, what is missing in these simple will kits is a description of what can go wrong. What happens if John Doe has two children? Or a wife? What will happen if James Doe dies before John Doe? Contrary to popular belief, you are not necessarily free to leave your estate to whoever you please. So a blank piece of paper may be called a legal will kit but the completed document may have no standing in a court of law."

What happens if you have any dependents currently in your care? If you provide for them today and they have an established relationship with you, then they may have a claim on your estate (depending on Provincial laws)

What if you have any debts that you owe or have anything owed to you?

What if you want to make a more detailed provision for each of your beneficiaries not being able to receive a particular part of your property. For example, if one beneficiary does not survive you, you may want to name an alternate beneficiary.

What if you are not absolutely explicit in your wording? Terms like divide my estate equally between my cousins and my friend Bill have at least five different interpretations.

Self-Counsel Press publishes various paperback books on a variety of legal topics. These books generally cost $15 or less, are written in plain English by lawyers, and can be found in most bookstores or ordered through the company's website at the address above. Alternatively, you may find that your local library carries several titles from this publisher. In many cases, the information in these books will answer your legal questions, and even if they do not and you are required to hire a lawyer, you will be better informed about your rights and will likely save on legal fees.
